The following caveat filed by Polly Garrel (Jarrell) refers to 100 hundred acres sold to her common-law husband, Jacob Shiflett, by his father John Shiflett and 39 acres (38 1/4) acres of land grant to Jacob Shiflett (see Plat for Jacob Shiflett below). The deed from John Shiflett to Jacob Shiflett in 1818 does not specifically indicate which John Shiflett has sold the land. I believe the deed below from Littleberry Lane to John Shiflett Jur. for 150 acres is the land of which John sells 100 acres to Jacob, his son. The other fifty acres of the tract may be the land that Polly lives on as mentioned in the 340 acre plat document for Henry B. Shiflett. If so, could this John Shiflett Jur., be the John who is the son of John Shiflett of the 1791 Will?

Polly Garrels gives the Register to im----- and that Stclair T. Dean the County Surveyor of Greene County made a Survey on the 4th day of April 1856 for H. B. Shifllett or for Henry B. Shifllett No. of Warrant sent by said surveyor for said H.B. Shifllett is 23595, and number of acres claimed 340 agreeably to the certificate of the said County Surveyor for the said Henry B. Shifllett. To all of which proceedings your undersigned caveator objects, for the following reasons - In the first place she has paid the tax on one hundred acres of it for more than twenty years and on thirty nine acres for a few years, having patent for the last amount of acres, and having been in possession of the same upward of forty years , and she claims the whole tract by the will of Jacob Shifllett who claims under a deed from his father John Shiflett who was in peaceable possession upwards of sixty years being the same land that is now taken up by said Henry B. Shifllett, within your counties boundaries as follows- Beginning on Lynches river at Henry Austin's corner thence with his line to the corner of John Lane's heirs, thence with their line to the corner of Wyatt Mills heirs, thence ------ side of the poison knowles and from thence along the Butter pole hill to the beginning. - You are therefore requested not to open any patent or grant to said Henry B. Shifllett for the reasons above stated and enter this caveat of the undersigned until the matter is determined law. The land within the above boundary has been surveyed by the County Surveyor, and it makes 542 acres, and has been ------ to your caveator. therefore for these reasons she asks the Register of said Land Office to enter this her caveat to the said H. B. Shifllett, as she has the proper evidence and documents to show that the land within said boundaries belongs to her.

This Indenture made the 27th day of April eighteen hundred and eighteen between John Shiflett of Orange County State of Virginia of the one part and Jacob Shiflett of said county of the other part- Wittnesseth that the said John for the consideration of one dollar to him in hand paid before the sealing and delivery of the presents as well for other consideration him it---- money hath bargained and sold and by these presents doth bargain and sell unto the said Jacob Shiflett a certain tract of land lying in Orange county containing one hundred acres and be the same more or less and bounded as follows Beginning on Lynches river at Henry Austin's corner thence with his line to the corner of John Lane's heirs, thence with their line to the corner of Mills heirs, thence ----- side of the poison knolls and from thence along the Butter pole hill to the beginning
To have and to hold the said land with all and singular appurtenances to the said Jacob and his heirs forever and the said John Shiflett for himself his heirs &c. doth covenant with the said Jacob his heirs &c. to warrant and defend the title to the said land to the said Jacob Shiflett and his heirs free from the claim of all and every person whatsoever In Testimony whereof the said John Shiflett has hereunto set his hand and affixed his seal the day and year above written

This indenture made the first day of March in the year of our Lord one thousand seven hundred and ninety two, Between Littleberry Lane and Mary his wife of the County of Fluvanna of the one part and John Shifflet, Jun'r of the County of Orange of the other part Witnesseth that the said Lane hath bargained sold let over and forever confirmed unto the said Shifflet one certain tract of parcel of land lying and being in the upper end of Orange County on the head branches of Lynches river beginning at a corner hycory on the side of the said river thence across chestnut trees on John Lanes line thence up the mountains to the west corner thence along the mountain to the river thence down the river to the beginning containing one hundred and fifty acres be the same more or less and the said Lane doth forever warrant and defend the right of the said land to the said Shifflet for the consideration of twenty pounds to him in hand paid the receipt whereof the said Lane doth acknowledge and hereby doth make unto the said Shifflet a good and lawful right in fee simple according to the true intent and meaning of the law for the conveyance of land and warrant and defend the said right clear of all incumbrances to him the said Shifflet and his heirs for such for their own possession and Behoof forever in witness whereof the said Littleberry & Mary, his wife have hereunto sett their hands and seals the day and year above written Littlebery Lain

The above described tract of Commonwealth's land, lying in the upper end of Orange County containing 38 1/4 Acres was surveyed for Jacob Shifflet by virtue of Land Office Treasury Warrant No. 8071, issued to Isaac Davis Jr on the 23rd Frebruary 1826 for one hundred Acres which have been legally assigned to said Shifflet.

"Tuesday, to wit - At a Court held for the County of Rockingham the 19th day of October 1813: Overseers of the Poor vs. Miley Shiflet on a recognizance as the father of a base born child of Ann Rains, on the motion of John Shiflet, Jacob Shiflet, & George Airy by their attorney and for reasons appearing to the Court, the said recognizance is ordered to be granted, from which opinion of the Court the attorney for the Overseers of the Poor excepted, which was signed and sealed as the law directs and ordered to be made a part of the Record."
