John Snow to Gatewood Shiflett

This Indenture made and entered into this fourteenth day of February in the year 1831 between John Snow of the County of Orange and State of Virginia of the one part and Gatewood Shiflett of the County and State aforesaid of the other part. Witnesseth That the said John Snow for and in consideration of one hundred dollars paid to him in hand by the said Gatewood Shiflett the receipt of which is hereby acknowledged have bargained and sold and doth by these presents grant bargain and sell unto the sd. Gatewood Shiflett his heirs and assigns forever a certain parcel of land lying in the County of Orange Containing twenty three and 1/2 acres be the same more or less and bound as follows. Beginning at a forked sycamore on the bank of the river then with Howard Shiflett's line on the side of Slater's mountain to a chesnut then running with the side of the mountain to three chestnut oaks thence to the river to a maple then down sd. River to the beginning. To have and to hold the said land with all its appurtenances to the said Gatewood Shiflett his heirs and assigns forever and the said John Snow for himself his heirs and assigns do and will forever defend the said Gatewood Shiflett agains the claim or claims of all and every person whatsover In testimony whereof the said John Snow has hereunto set his hand and affixed his seal the day and year first above written.

This Indenture made this fourteenth day of February (of our land) in the Year One thousand eighteen hundred and thirty one between John Snow of the County of Orange and State of Virginia of the one part and Howard Shiflett of said County of the Other, Witnesseth that the said John Snow for and in consideration and more particularly for the sum of one hundred dollars paid in hand the receipt whereof he doth hereby acknowledge hath given granted bargained and sold and by these presents does give grant bargain and sell unto the said Howard Shiflett his heirs and assigns a certain tract or parcel of land lying and in the County of Orange Containing twenty three and 1/2 be the same more or less lying at the low end of the tract that the sd. Snow bought of Reuben Robud and bounded as follows. Beginning at a dogwood on the bank of the river in Douglas line and running sd. line to the side Slaters mountain to a chesnut oak and thence the side of said mountain to a chesnut and thence to a forked sycamore on the bank of said river and thence down the -- -- said river to the beginning. To have and to hold the said tract or parcel of land with the tenements heretofore mention or intended to be bargained and sold unto the said Howard Shiflett his heirs and assigns forever to and for the only proper use and be of him the sd. Howard Shiflett his heirs and assigns forever and the said John Snow for himself and his heirs the said land with all and singular the premises and appertenances before mention unto the said Howard Shiflett his heirs and assigns forever the claim or claims of him the sd. John Snow his heirs and assigns and of all and every person or persons whatsoever shall or do warrant and forever defend by these presents I[n] witness whereof the sd. John Snow has hereunto set his hand and seal the day and Year first above written.

This Indenture made and entered into this 10th day of December 1831 between Howard Shiflet Exor. of John Shiflet decd. of the County of Orange and State of Virginia of the one part and John Shiflet of the County and State aforesaid of the other part. Witnesseth that the said Howard Shiflet for and in consideration of the sum of one hundred and thirty six dollars and ninety two cents lawful money of the Commonwealth to him in hand paid by the said John Shiflet the receipt of which is hereby acknowledged have bargained and sold and by these presents doth bargain and sell unto the said John Shiflet his heirs and assigns forever a certain parcel of land lying and being in the County of Orange containing one hundred and twenty two and 1/4 acres and bounded as follows. This indenture made this 18th day of February eighteen hundred and thirty two Between Cowherd Shiflet executor of John Shiflet deceased of the one part and John Frazier on the other part Withforth that the said Cowherd Shiflett hath this day bargained and sold to the said John Frazier one certain tract or parcel of land lying in the County of Orange on Roaches River containing by estimation ninety acres be the same more or less for the sum of One hundred Dollars and 80 cents Current money of Virginia the receipt of which is hereby acknowledged and bounded as follows: (Viz.) This Indenture made and entered into this 7th day of August, 1832 Between George Elliott and Judith, his wife, (formerly Judith Martin) of the one part and Jno. Shiflett of the other part, all of the county of Albemarle and State of Virginia Whereas the said Geo. Elliott and Judith, his wife, for a valuable consideration to them in hand paid by James H. Langford, at & before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath bargained [and] sold to the said Langford, a certain piece or parcel of land, and the [said] Langford, having sold the same to the said Jno. Shiflett, hath requested the said Elliott and wife to make the conveyance to said Jno. Shiflett, instead of himself - Now therefore, this Indenture Witnesseth, that the said Elliott and Judith, his wife, for and in consideration of the promise of further consideration of One dollar to them in hand paid by the said Shiflett, the receipt whereof is hereby acknowledged, have granted, bargained, sold and by these presents do grant, bargain & sell unto the said Jno. Shiflett one undivided eighth of a tract of land, formerly belonging to Jacob Martin dec'd. & was willed by him to his children at his decease, which said Judith, is one of the legal heirs of the said Jacob Martin dec'd. which will appears by reference to Said will, one of record in the Clerk's Office of Albemarle County Court, which sd. eighth part of land is situated lying and being in the county of Albemarle, adjoining the lands of Fountain Richard's, Chas. Langford, Elisha Lane & others - To have and to hold the said undivided eighth of the said tract of land willed to the heirs of sd. Jacob Martin decd. with the appurtenances unto him the said Jno. Shiflett, his heirs and assigns forever, And the said Geo. Elliott & Judith his wife, for themselves, their heirs, do hereby covenant to and with the said Jno. Shiflett his heirs etc. that there will and by these presents do, forever warrant and defend the title to the said one eighth of said tract of land and Appurtenances. This indenture made this 11th day of August one thousand eight hundred and thirty two. Between Howard Shiflet of the County of Orange and State of Virginia of the one part, and John C. Harrison of the County and State aforesaid of the other part. Witnesseth that the said Howard Shiflet hath this day bargained sold and by these presents doth bargain and sell to the said John C. Harrison one certain tract or parcel of land lying and being in the County of Orange near the head waters of Roaches river and containing by estimation forty nine acres be the same more or less for the sum of ninety eight dollars current money of Virginia . . .Beginning at a large hickory, gum and chesnut on the west side of Roaches river thence with the meanders of the said river 37 poles to a Hazlenut bush an alder and the root of a sycamore stump part of the body lying on the ground in Hat gut run at the junction with roaches river thence up the meanders of the said run 196 poles to two sycamores in flat-gut run and supposed to be in Taylor's line, thence N 7 E 30 1/2 poles to two chesnut oaks, small chesnut and dogwood on the north side of ridge near the top thereof thence N 51 E 70 poles to two small poplars and hickory in Creeds line now established as a corner between said Harrison and Shiflet thence S 38 poles to two chesnuts near the top of an Ivy Cliff established as a corner between sd. Harrison and Shiflett thence S 60 E 75 poles to stakes and rocks in the field where three cherry trees are to be planted and established as a corner between said Harrison and Shiflet thence N. 65 1/2 E 84 poles to the beginning. To have and to hold the sd. tract or parcel . . .to him the said John C. Harrison . . .And the said Howard Shiflet for himself (and as the administrator of Lewis Davis deceased) will warrant and forever defend the right and title to the said John C. Harrison . . .In witness wherof the said Howard Shiflet to these presents hath affixed his hand and seal this day and year above written.

This Indenture made and entered into this third day of December in the year of one thousand Eight hundred and thirty two. Mildred Martin of the County of Augusta and State of Virginia of the one part and John Shiplett of the County of Albemarle and State aforesaid of the other part Witnesseth that the said Mildred Martin for and in consideration of the Sum of twenty five dollars lawful money to her in hand paid by the said John Shiplett the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth Grant bargain and sell unto the said John Shiplett and to his heirs and assigns forever one eight part of a certain tract of land conveyed to me by the Will of my farther Jacob Martin Dec'd. of the County of Albemarle State aforesaid lying and being in said County of Albemarle on Kids Creek containing by estimation one hundred twenty four acres more or less adjoining the lands of Charles Langford, Nathaniel Shiflett and others. To have and to hold the one Eight of said tract or parcel of land, aforesaid together will all and Singular the appurtenances thereunto belonging or in any wise appurtaining unto the said John Shiplett his heirs and assigns forever and the said Mildred Martin for herself and her legal representatives do by these presents covenant and agree to with the said John Shiplett his heirs and against the Claim of all other persons whatsoever. This Indenture entered into the [blank] day of February in the year 1833 between Absalom Shiflett Edward Shiflett and Joise his wife and Winney Herring all of the County of Orange and state of Virginia of the one part and Felix Williams of the County and State aforesaid of the other part. Witnesseth that Absalom Shiflett, Edward Shiflett and Joise his wife and Winney Herring in consideration of the sum of one dollar of lawful money of this Commonwealth to them in hand paid by the said Felix Williams at or before the ensealing and delivery of these presents (the receipt whereof is hereby acknowledged) Have bargained and sold and by these presents do and each of them doth bargain and sell unto the said Felix Williams his heirs and assigns a certain part of a tract of land formerly owned by James Herring decd. adjoining the [lands] of Edward Rusell Edward Ship Parke Goodall Charles Parrott and William Early parts five in number together with all the appertunances thereunto belonging. This Indenture made and entered into this 2d day of December 1833 Between Richard Snow of the one part and John Shiflett of the other part, both of the County of Albemarle Virginia. Witnesseth That the said Richard Snow, for and in consideration of the sum of two hundred and twenty five dollars lawful money of Virginia to me in hand paid by the said John Shiflett the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth grant bargain and sell unto the said John Shiflett his heirs and assigns a certain tract or parcel of Land lying and being in the County of Albemarle Containing eight acres on which is situated a grist Mill and bounded as follows: Beginning at a Sycamore, on the south side of Buck mountain creek, running thence down the same on the Creek thereof to pointers two sycamores in or near Lewis Davises line above the said Davises Mill thence North to a white Oak, to a corner on a small black gum near the path, thence west to two Red Oaks marked to the Side lines, thence to two white oaks thence to pointers Red Oak, white Oak and dogwood on the South Side of a Ridge from thence South Crossing above the fork of the said Creek to the beginning, together with all and Singular the appurtenances thereunto belonging or in any wise appertaining, to have and to Hold, the said eight acres of Land with its appurtenances unto the said John Shiflett his heirs and assigns forever, and the said Richard Snow for himself, his heirs Executors & administrators do Covenant with the said John Shiflett his heirs and assigns that he the said Richard Snow as aforesaid his heirs executors & administrators the said eight acres of land with its appurtenances unto the said John Shiflett his heirs & assigns against the claim or Claims of him the said Richard Snow as aforesaid his heirs and of all and every person or persons whatsoever claiming under him and him only, Shall and will warrant and forever defend and by these presents. Witnesseth that the said Winston Shiflett and Milly Shiflett his wife for and in consideration of the sum of one hundred and ninety dollars current money of Virginia to him the said Winston Shiflett in hand paid the receipt whereof is hereby acknowledged the said Winston Shiflett hath bargained granted and sold and by these presents doth grant bargain and sell unto the said Benson Shiflett his heirs and assigns forever one certain tract or parcel of land lying a being in the County of Orange and State of Virginia and containing by estimation one hundred and eight acres be the same more or less (to Wit) beginning at a pine and Maple on the South side of Lynches river running thence South eleven degrees west eighty four poles to a chestnut oak thence South Seventy one degrees East thirty four poles to an oak near some large rocks thence South thirtyfive degrees East ninety five poles to a large pine on the County line thence North fifty two degrees East one hundred and forty eight poles to a beach on said river on which the cuiras began thence up the several courses? of said river to the Beginning and also all water courses rivulets buildings and improvements whatsoever belonging or in anyway appertaining to said tract and of him the said Winston Shiflett of in and to the messuage? etc. unto the said Benson Shiflett his heirs and assigns forever and the said Winston Shiflett and his heirs doth hereby warrant and defend the right and title of the above described tract of land against all persons and every person clear of all incumbrances In Witness where of we have hereunto set our hands and Seals the day and date above first written. Article of Agreement made and entered into this day of February one thousand eight hundred and thirty four between Howard Shiflet (executor of John Shiflet Dec'd.) of the County of Orange and State of Virginia of the one part and Michael Shiflet of the County of Albemarle and State aforesaid, Witnesseth, that the said Howard Shiflett hath this day bargained sold and by these presents doth bargain and sell to Michael Shiflet and certain tract or parcel of land lying and being in the county of Albemarle on the County mountain containing by estimation nineteen acres be the same more or less for the sum of fourteen dollars the receipt of which is hereby acknowledged, and bounded as follows VIZ. Witnesseth that for and in consideration of the sum of Twenty dollars thirteen of which is yet unpaid for which the said Shiflett has executed his bond he the said Oliver by his attorney hath bargained and sold and doth by these presents bargain sell and convey unto the said Shiflett a certain parcel of land in the County of Orange on the Blueridge mountain being the same in the possession of the said Shiflett and a part of the said Robert Olivers large Survey of 099 50 acres. Bounded as follloweth Beginning at a white oak on the east side of a hill side adjoining the land of Edward Shiflett and corner to the same thence on the supposed line of James Brysons Survey claimed by the heirs of James Early S82E60 poles to a chestnut thence N27W104 poles to a chestnut oak thence N58W44 poles to a chestnut in the thence [sic] through the same on a supposed line of the said Brysons Survey S8W118 poles to the Beginning containing thirty three acres So the same more or less this sale and conveyance is made with the express understanding that the aforesaid Survey is not to interfere with the Survey of the said Brysons the said Shiflett having caused the lines of the said thirty acres to be executed himself and should the lines include any part of the said Brysons Survey and the said Shiflett should be ejected therefrom liberty is reserved that he is to have his quantity by extending further into the said Olivers Survey to adjoin the land of Kennedy To have and to hold the land aforesaid, unto them the said Shiflett and to his heirs and assigns forever free from the claims of the said Oliver his heirs and assigns with this covenant, that should the said Shiflett his heirs or assigns be legally evicted from any part of the land hereby sold other than such portion that may be be written the lines of the said Brysons Survey that the said Oliver here will refund the purchase money rateably per acres in proportion to that part of the Whole. Orange Humane Society to Isaac Shiflett

This Indenture made this fourth day of July 1839 between the Orange Humane Society of the first part and Isaac Shiflett of the County of Albemarle of the second part. Whereas Richard Bruce by his deed bearing the 9th day of September 1789 and of record in Albemarle County, conveyed to William Bell Executor of William Monroe decd for the purpose of securing the payment of £107.3.9 which the said Bruce was owing to the Monroe as aforesaid, two tracts of land lying in Albemarle County, one supposed to contain 300 acres and the other 200 acres, and whereas the said William Monroe by his last will and testament directed estate should be sold and the proceeds thereof paid at Interest which should be applied to the education of poor children, and whereas an act was passed by the Legislature of Virginia on the 19th day of January 1811 vesting all the estate of the said William Monroe in a body politic and corporate styled the Orange Humane Society by virture of which act the said from Richard Bruce to William Monroe became ---- in said Society and whereas an amended decree obtained from the County Court of Albemarle ---- Chancery at its November term 1819 directing the sale of said Land of Bruce and appointing Richard Chapman as Commissioner to carry said decree into effect and whereas a sale was advertised by said Chapman of said Land to be made at Orange Court House on the first day of Orange March Court of year 1839 and before the taking place of said sale under said Decree the said Shiflett who represented himself as one of the occupiers of said Land, proposed to Orange Humane Society to undertake the payment of Debt from Bruce to Monroe transferred to said Society on condition that said Society would convey and transfer to him, all its interests and rights under the Deed and decree herein before recited. And the said Orange Humane Society (being governed in its decision on the proposition by the principles of equity) considering that there were several occupiers of said Land, besides said Shiflett who should also have an opportunity of participation in any arrangement it shall make as to transfer of --- agreed with said Shiflett to make said transfer to him on condition that he should allow said joint occupiers of said land at any time within three months of the date of a written notice to them or each of them participate with him in all and each of the ---- from this transfer to him, that is to a --- of the part of said Land so held by them, on a --- by them to said Security of a part of said debt Bruce proportioned to the amount and value of such so held by them respectively. And whereas a --- said debt from Bruce to Monroe was made showing interest to amount to $1038.59 which the said Shiflett was willing to pay said Society as aforesaid, therefore and in consideration of the promises and also for consideration of the said sum of $1038.59 to the Society paid, at and before the sealing and delivery presents (the receipt whereof is hereby acknowledged) said Society has granted, transferred and conveyed these presents does grant, transfer and convey unto Shiflett his heirs and assigns, all the rights, title and interest of the said Orange Humane Society in the said 500 acres of land herein before described and to hold unto him the said Shiflett and his heirs? upon the special conditions herein before recited said Orange Humane Society hereby warrants to said and his heirs the title, the said land herein intended conveyed, against the claim of it the said Society and sons claiming under it upon a performance by the --- of the conditions herein specified. Jasper Smith to William Shiflet

Note:Vicky Hensley e-mailed me and told me this should be Casper Smith, not Jasper. That Casper is of German parentage; his father did not speak English; that his siblings all died on the boat from Europe and only he survived because he was still being nursed. I will have to find the copy of the deed to check the name. However, even if the deed says Jasper, the clerk still could have made an error. Vicky says William bought a lot of land from Casper Smith, not just this one transaction, but we haven't found those deeds yet.

Know all men by these presents that I Jasper Smith of the County of Greene and state of Virginia am held and firmly bound to William Shiflet in the sum of five hundred and fifty dollars current money of the commonwealth for the true payment whereof I bind myself my hers etc. firmly, by these presents sealed with my seal and dated this 4 day of December 1839.

The condission of the above obligation is such that whereas I the said Jasper Smith hath this day bargained and sold unto the sd. William Shiflet a certain parcel of land laying a part in Greene and a part in Rockingham and situated on or near the top of the blue ridge where Richard Lam formerly lived, for and in consideration of the sum of two hundred and twenty five dollars for which bonds are executed by the sd. Shiflet and bound as follows: beginning at Thomas Shiflets corner in Bledsoes line, thence with the said Bledsoes line to the corner, thence to two chesnuts oakes, thence to some ash saplins, thence to two chesnut oaks, from thence to William Smith corner, thence to Bledsoes second corner, thence to Bledsoes beginning corner thence with William Lamb line to the Hickory corner, thence to the beginning.

Now I the said Jasper Smith bind myself as above to make or cause to be made a good general relvant deed when the half of the money is paid for said land; now if the deed shall be made agreeably to this agreement, then the obligation shall be void otherwise to remain in full force.
