This Indenture made this first day of December one Thousand Seven hundred & Eighty Two Between George Lumsden & Elizabeth is wife of the County of Louisa of the one part and Thompson Walton of the county of Albemarle of the other part witnesseth that the said George Lumsden and Elizabeth his wife for & in consideration of the Sum of four hundred pounds Current money of Virginia the Receit of which the Said Lumsden doth acknoledge. Have given granted Bargained Sold let over and By these presence do confirm'd unto the said Thompson Walton his Heirs &l; assigns forever a certain track or parcel of Land lying & being in the County of Albemarle Containing by Estimation two hundred & ninety four acres more of less, Being the Tract the said Walton now lives on and was formerly Bounded by the following Lines (viz:) Begining at Richard meadows his corner pine in the Line of Capt Joseph Martins, thence on Meadows's Line South Twenty Five Degreees East Two hundred & fifty two poles to his Corner small pine Thence South Thirteen Degrees West one hundred and forty four poles to Henry Bunch's Corner of several pines, Thence his Line North forty Degrees West one hundred & Ninety Two poles to his Corner of several Trees, thence on his line North Seventy poles to his cornor, Thence on his Line North Twenty nine degreees west two hundred and fifty four poles to Capt Joseph Martins Line in the said? Bunches Line thence on Martins line south twenty? --- degrees west one Hundred & sixty six poles to the Beginning To have and to hold the Said Lands with its appertenances unto the said Thompson Walton his heirs & assigns for ever and the said George Lumsden & Elizabeth his wife for themselves and there heirs aforesaid tract of Land with all and every the appurtenences thereto belong or in any wise appertaining unto the said Thompson Walton his heirs & Assigns will warrant and forever defend against the against the titles Claim or Demand of any person or persons whatever in witness whereof the siad George Lumsden and Elizabeth his wife have set there hands & seals the Day and year above written.

To all Christian people To whom this present writing Shall come Greeting; Know you that I Richmond Walton, of Albemarle County & parish of Fredricksville, planter, for divers good causes & consideration moving me herunto, but more especially for the natural love and affection I have and do bear to my beloved Children: Ison Walton, Elizabeth Thomson Walton, Mary Carlton Walton, Francis Hart Walton, Edward Byerus Walton, Edmond Pendleton Walton, Dyce Boales Walton, Richmond Terrill Walton, John Thomson Walton, I give and bequeath unto the above said Beloved Children, and by these presents do freely grant unto the said Children all my lands, goods, & chattels I now have, or hereafter shall have to be equally divided amongst them or their heirs lawfully begotten of their bodies forever; Of which these presents I have delivered an Inventory to be put on Record, Signed with my own hand and bearing even date to have & to hold all the Lands, Goods & Chattels as their proper own, absolutely without any manner of condition whatsoever, in witness whereof I have hereunto set my hand & seal this 12th day of January 1786.

In the name of God Amen. Be it remembered that I Richmond Walton of Albemarle county State of Virginia have taken in consideration the uncertainty of this mortal life and being of Sound mind and memory and common health of body, do make and publish this my last will and testament in manner & form following.

That is to say First Let all my Just Debts be paid.

Item,, then first I give and bequeath unto my bleoved wife Elizabeth Walton all my estates both real and personal goods & chattels of whatsover, I will and order that she shall peacably enjoy the same during her natural life. And after the Decease of my beloved wife, my will and desire is that my executors hereafter named Shall sell according to Law, all my estate both real and personal goods and chattels of whatsoever kind and Divide the same that is the money or profit arising there from, into Eleven equal parts or lots, and to be managed as hereafter named.

Item,, I Lend unto my daughter Elizabeth one equal part or Lot of the profit arising from the sale of my estate, during her natural life, and after her decease I give the same unto her children foerever, to be equally divided between them to enjoy the Same forever.

Notes:
The above 2 documents, taken at face value, with no other documentation, imply that Elizabeth was Richmond's second wife. The first deed lists his first nine children. The inclusion of John Thompson Walton in the list of children in 1786 revises his birth date, which was calculated from his death record as 1789. In 1786 John would have been either born that same year, or only be 1 year old. Richmond does not list a wife in this deed either. The deed of 1786 was probably made to protect the interests of Richmond's children by his first wife. The last 3 children: Joel, Jane and Carean are included in the list of heirs in 1831. It is also interesting to note that in his will, Richmond specifically mentions by name his 4 living daughters. Albemarle County Chancery Book 2, page 324 apparently contains transcripts of several documents pertaining to the estate settlement of Richmond Walton, but we don't have them. Perhaps they would clarify the issue of Richmond's wife or wives.

This Indenture made and entered into this 1st day of April 1826 between Edward Walton of Estill County and state of Kentucky of the one part and David H. Walton of the County and state aforesaid of the other part. Witnesseth that the said Edward Walton, for and in consideration of the sum of six hundred and twenty dollars to him in hand paid, the receipt whereof he doth hereby acknowledge, hath this day granted bargained and sold, and by these presents doth grant bargain and sell unto the said David H. Walton a certain tract or parcel of land containing one hundred and forty acres and being in the said County of Estill it being the land whereon the said Edward Walton now resides. Also two horses, nine head of cattle, forty head of hogs, twelve head of sheep, a seventy five gallon still, and all my household and kitchen furniture, all of which property the said Edward Walton doth and will warrant and forever defend unto the said David H. I, Edward B. Walton of Estill County and state of Kentucky do hereby make my last will and testament in manner and form that is to say 1st I wish and desire that after my death that my beloved wife Susannah Walton shall keep possession of all my effects both real and personal during her life time and her widowhood for her support but if she should marry then for her to take a child's part or one third part accord to the way the law now ___ this I leave to her choice but at her death or marriage for all the remainder of my estate of any kind both real and personal be publicly sold and the money equally divided between my children after all accounts I have against them are balanced and settled as hereafter mentioned. I have paid for my son David H. Walton our debt to S. Noland Attorney for Bates claim against said Walton for thirty three dollars and Seventeen cents paid 28 Jany 1850 33.17 paid same 17 Jany 1848 thirty two dollars & 65 cts 32.65 for which part must be calculated from the dates agt David H. Walton. Also our debt I paid D. H. Goodlow(?) on Execution for thirty three dollars $33.00 Sixteen dollars for barrel of whiskey 32 Gallons $16.00 Three dollars loaned money $3.00 Twenty dollars on a note I have lost $20.00 Seven dollars & fifty cents execution pa S. W. Newman $7.50 Six dollars pa on Exon in favor of A. Shepherd $6.00 The above debts all of which I have paid for my son D. H. Walton and accounts which I desire to be paid and settled or balanced so as to make an equal division between all of my children as follows, Viz David H. Walton, Thompson D. Walton, John T. Walton, Miley G. Walton, Serina G. Bowman, Matilda J. Jones, William H. Walton, Mosias J. Walton, Elizabeth M. Jones and Richman Washington Walton. 2nd It is my wish that fifteen dollars be paid by my son Miley G. Walton for House least (?) he has had of me ---------- at his mothers death. 3rd All the rest of my estate both real and personal of what nature or kind soever it may be not herein before particularly disposed of, I desire may be equally divided among my several children here before named which I give to them, their heirs, Executors, Administrators, and assigns forever; and lastly I do hereby constitute and appoint my youngest son Richmond Washington Walton Executor of this my last will and testament hereby revoking all former wills heretofore by me made. Note: While these records were in the 1777 Loose Court Papers Box in Albemarle Co., it is thought by some researchers that the actual date of the suit is earlier, but this is impossible. According to Velpo Robertson, in the pension application of a John Davis, Richard Snow testifies that he m. in 1780; therefore the suit had to have been first filed after that date.

In the Court of Albemarle County in Chancery: Complaint of Lewis Davis, Jr., Richard Snow and Lorana his wife, formerly Davis, Mary Davis and Sally Davis, an infant, by Richard Snow, her guardian, who are children of Lewis Davis, who was son of Henry Davis, dec'd. Henry Davis of Hanover County made his will 24 July 1773 and devised to his wife Elizabeth two negroes, Joe and Fan, for life, and then to his daughter Rhoda Davis, and also to Rhoda, two slaves, Jude and Minor, but if she dies without issue, the negroes given to her and to his wife Elizabeth are to be divided among said Henry's grandchildren, being the children of his son Lewis Davis and his daughter Mary Harris. Two slaves, Sam and Agge, to be sold at auction to pay debts. Land to be sold and profit divided among grandchildren as noted above. .Wife Elizabeth and son Lewis were appointed his executors. Soon after the death of Henry Davis, about 17 Oct. 1773, Lewis Davis, the executor, proved the will at Hanover County Court, and possessed himself of the testator's estate to value of 1000 pounds. By accounts, after debts, there was 435 Pounds, 5 shillings. There appears to be due to each legatee 82 Pounds, 18 shillings, 7 & 3/4 pence. Your orators show that said Lewis Davis, Jr., Loraner Snow, Mary Davis and Sally Davis are four of the residuary legatees mentioned in the will, being children of testator's son Lewis, and that Loraner married Richard Snow since the death of Henry Davis. They have several times applied to the executor to divide the estate, but have gotten no results. Executor sometimes pretends the testator made no such will and sometimes that there is no estate left after debts. Court is asked to compel Lewis Davis to divide the estate.
